Welcome to RIVAY. These Terms of Service (“Terms”) apply to your use of rivayjewelry.com and purchases from our online store. The store is operated by Heyi Culture Limited, trading as RIVAY (“RIVAY,” “we,” “us,” or “our”). Our store is hosted by Shopify, which provides the ecommerce platform.
Please read these Terms before placing an order. By placing an order, you agree to these Terms to the extent permitted by applicable law. Nothing in these Terms limits rights that cannot lawfully be waived under applicable U.S. federal or state consumer protection laws.
1. Eligibility and Account Information
To place an order, you must be at least 18 years old and legally able to enter into a binding contract, or act through a parent or legal guardian who places the order. You must provide accurate contact, billing, shipping, and payment information and have authorization to use your payment method. If you create an account, keep your credentials secure and notify us promptly of suspected unauthorized access.
2. Our Jewelry and Product Information
RIVAY offers jewelry that may include jade, freshwater pearls, sterling silver, natural gemstones, crystals, and handcrafted details. The materials, dimensions, finishes, and other specifications stated on the individual product page describe that item; do not assume that every piece uses the same materials.
Natural materials and handcrafted pieces may vary in color, shape, texture, inclusions, and finish. Photography, lighting, and screen settings can also affect appearance. Reasonable variations consistent with the product description are part of a piece’s character. This does not excuse a material misdescription, undisclosed substitution, manufacturing defect, or damage.
Please review sizes, materials, and care guidance before purchase. Jewelry can be delicate and may contain small parts. Keep it away from young children. If you have a metal sensitivity, review the listed materials and contact us with questions; we do not promise that every item is suitable for every wearer. References to symbolism or cultural traditions are not medical claims.
3. Orders and Acceptance
Submitting an order is an offer to purchase. An automated order acknowledgment confirms receipt but does not by itself confirm acceptance. We accept your order when we send a shipping confirmation or expressly confirm acceptance in writing. Custom-order acceptance and production details may be confirmed separately in writing.
Before acceptance, we may decline or cancel an order for a genuine reason, including unavailable stock, an uncorrected material listing error, suspected fraud, or a legal restriction. We will notify you and promptly refund any payment collected for an order we cancel. We will not substitute a materially different product or charge a higher price without your agreement.
4. Prices, Payments, and Promotions
Prices are displayed in U.S. dollars unless another currency is expressly shown. The checkout identifies the currency, product charges, applicable discounts, shipping charges, and taxes or duties collected by us. Your bank or payment provider may impose its own currency conversion or transaction fees.
Prices and promotions may change for future purchases. Changes do not retroactively alter an accepted order. Promotional offers are subject to the conditions displayed with the offer, including any expiration, minimum spend, exclusions, or combination restrictions. If a material pricing error affects your order, we will contact you to confirm the corrected terms or cancel and refund the affected purchase.
5. Shipping, Pre-Orders, and Import Charges
Shipping methods, delivery estimates, tracking, and import-charge information are described in our Shipping Options page and at checkout. Product-specific pre-order or custom-order timelines disclosed before purchase apply to those items. Delivery estimates are not guaranteed arrival dates unless expressly stated.
For U.S. orders, we will ship within the time stated before purchase or, if no shipment time is stated, within 30 days, as required by applicable law. If we cannot meet the required shipment time, we will provide the legally required delay notice and an opportunity to agree to a revised shipment date or cancel for a prompt refund. If the required consent is not obtained, we will cancel and refund as required by law. Carrier or customs delays do not remove any mandatory rights you have.
Please provide a complete and accurate address. If tracking indicates a problem, or a package is missing or damaged, contact us promptly so we can investigate and provide the appropriate resolution. A carrier’s delivery scan does not by itself override your legal rights.
Unless checkout expressly states that import charges are included or prepaid, customs authorities or carriers may collect additional lawful duties, taxes, or fees from the recipient. See Shipping Options for details. We do not guarantee any particular customs exemption.
6. Returns, Cancellations, and Defective Items
Except where required by law or provided in our Returns & Exchanges Policy, purchases are final sale. We do not generally accept change-of-mind returns or exchanges for personal preference or incorrect size selection. Please review that policy before checkout.
Custom, personalized, engraved, resized, altered, and made-to-order pieces generally cannot be canceled or returned for change of mind once work begins. Contact us as soon as possible with any cancellation request; we cannot guarantee a processing order can be stopped. These restrictions do not limit statutory cancellation rights for delayed shipment or remedies for defective, damaged, incorrectly supplied, or materially misdescribed goods.
For damage visible on arrival or an incorrect item, please contact us within 7 days of delivery where reasonably possible, with your order number and supporting photographs. This requested reporting period does not shorten a legal claim period or eliminate rights concerning hidden defects. Retain the item and packaging while we review your concern, and obtain return instructions before shipping anything back. We will provide any remedy required by applicable law.
7. Jewelry Care and Warranties
Follow the care instructions supplied with your piece. Exposure to chemicals, cosmetics, moisture, impact, or improper storage can affect jewelry. Normal wear, accidental damage, and damage caused by misuse may fall outside available remedies, subject to applicable law.
Any express warranty or product promise stated at the time of purchase remains applicable according to its terms. Nothing here disclaims a warranty or remedy that cannot lawfully be excluded, or treats a manufacturing defect as ordinary wear.
8. Acceptable Use and Intellectual Property
Do not use the store for fraud or unlawful activity, interfere with its security or operation, introduce malicious code, impersonate others, or infringe anyone’s rights. We may restrict access where reasonably necessary to address such conduct. This does not cancel our obligations regarding existing orders or lawful refunds.
RIVAY branding, original photographs, text, designs, and other store content are owned by us or our licensors and protected by applicable intellectual property laws. You may use the website for personal shopping purposes. Commercial copying or exploitation requires the relevant rights holder’s permission, except where the law permits otherwise.
9. Reviews and Other Submissions
You retain ownership of reviews, photographs, or other content you submit. By submitting content for publication on our store, you grant us a non-exclusive, royalty-free license to display and reproduce it for that purpose, including reasonable formatting. You confirm that you have the necessary rights and that your submission does not unlawfully disclose another person’s information.
We may remove unlawful, abusive, deceptive, irrelevant, or infringing content. We do not prohibit honest reviews, require positive reviews, or impose penalties for a lawful negative review. Any separate promotional use of your content will be subject to any additional permission required by law.
10. Privacy and Third-Party Services
Our Privacy Policy explains how personal information is handled. Marketing consent is separate from accepting these Terms, and you may unsubscribe from promotional communications using the instructions provided.
Payment services, external websites, and other third-party features may have their own terms. Review them when applicable. Links do not necessarily indicate endorsement. Our use of Shopify or another provider does not remove our responsibility for obligations we owe you as the seller.
11. Website Availability and Liability
We make reasonable efforts to keep the store accurate and available, but do not guarantee uninterrupted or error-free access. We may maintain, update, or suspend website features without affecting obligations already owed to you.
To the extent permitted by applicable law, we are not responsible for indirect or consequential losses arising from use of the website that were not reasonably foreseeable when the relevant contract was made. This provision does not exclude or limit liability for fraud, willful misconduct, gross negligence, personal injury where such exclusion is prohibited, or any other liability that cannot lawfully be excluded. It does not limit required refunds, product remedies, applicable warranties, or rights under consumer protection law. If your state does not permit a limitation, it does not apply to you.
12. Governing Law and Disputes
RIVAY is operated by Heyi Culture Limited, a Hong Kong company.
These Terms and Conditions are governed by the laws of the Hong Kong Special Administrative Region. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
The governing-law and jurisdiction provisions above apply to the fullest extent permitted by applicable law. Nothing in these Terms deprives U.S. consumers of any non-waivable rights or mandatory protections under applicable U.S. federal or state law, including any right to bring a claim in another court where that right cannot lawfully be excluded. If a mandatory legal requirement conflicts with these provisions, that requirement prevails to the extent of the conflict.
Please contact us first if you have a concern so we can try to resolve it. You are not required to complete this informal process before exercising a legal right. These Terms do not require binding arbitration or waive class actions or jury trials.
13. Changes and General Terms
We may revise these Terms by posting an updated version and revision date, with additional notice or consent where required by law. The version made available when you place an order governs that order unless you agree otherwise or the law requires otherwise. Revisions do not retroactively remove accrued rights.
These Terms, together with the policies and specific purchase terms disclosed to you, govern the relevant transaction. Product-specific or individually agreed terms control the matters they expressly address; mandatory law always takes priority. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a right is not a waiver of that right.
